Case Study: AT&T Mobility, LLC

Environmental Due Diligence

All property transactions come with varying levels of risk. As a liability protection against unknown environmental conditions, municipal, commercial, and residential entities often opt for completing due diligence practices. Levels of due diligence can vary from a simple environmental screen to a more comprehensive Phase I Environmental Site Assessment. Other services include vapor intrusion testing, contaminant delineation and remediation, and hazardous materials management. Impact7G provides an in-depth knowledge base of environmental regulations to implement a successful strategy for each client on a nationwide basis.

Prior to tower acquisition, Impact7G can perform environmental compliance audits to assess the value of the tower as a co-locatable asset, determine tower value prior to purchase, and determine potential environmental compliance issues that may exist.

National Environmental Policy Act

In accordance with Federal Communications Commission (FCC) regulations, all antenna structure owners must consider the potential environmental effects of proposed communication structures prior to construction. Impact7G assists clients in evaluating these environmental effects using an industry accepted NEPA Checklist. The NEPA checklist determines whether the undertaking will affect, officially designated wilderness areas, officially designated wildlife preserves, federally listed, threatened or endangered species, Historic Sites listed or eligible for listing in the National Register of Historic Places, Indian religious sites, floodplains and whether the undertaking will involve wetland fill, deforestation, water diversion, high intensity white lights, or excessive radio frequency emissions.

We offer additional environmental services such as Environmental Assessments (EA), Environmental Impact Statements (EIS), and Wetland Delineations when required.

Impact7G biologists are available to assist in making bird nest activity determinations in accordance with the Migratory Bird Treaty Act (MBTA). This can help to avoid any maintenance delays on communication structures located in coastal areas or along large bodies of water.

National Historic Preservation Act

Projects involving Federal money or permits and those operating near sensitive cultural areas often encounter the National Historic Preservation Act (NHPA), State-based historic preservation laws, or local sensitive area ordinances requiring archaeological or architectural documentation. These processes rely deeply on a sound understanding of potential historic places or artifacts and require constant communication with the State Historic Preservation Office (SHPO) and/or Tribal Nations. Impact7G staff have decades of experience in negotiating contracts for telecommunications clients where NHPA or other preservation laws are involved. Furthermore, our staff is well versed in FCC procedures related to historic preservation.

FCC & FAA Compliance

The Federal Communications Commission (FCC) has separate procedures for compliance with NEPA-related activities for construction of new towers or collocation of antennas on existing structures. Depending on the tower’s height and location, Federal Aviation Administration (FAA) notification and approval may also be required for NEPA compliance. When completing environmental due diligence for proposed wireless telecommunications projects, our clients benefit directly from the knowledge and value these relationships provide, whether it’s negotiating an agreement or understanding FCC and FAA requirements.

Impact7G staff are well-equipped and well acquainted with all aspects of regulatory services including unique sites.  Though non-tower installations that can often take place on or near environmentally or culturally sensitive areas, Impact7G has vast experience in navigating federal and state offices to ensure projects are completed cost-effectively and within a defined timeframe. Our range of environmental professionals – from archaeologists to wetland scientists – allows us to provide our clients with the services necessary to complete self-supporting, monopole, guy-wire towers, non-tower installation and modifications, and small cell access node projects.
